But investigators also said the officer could have been driving anywhere from 59 to 80 miles an hour in an area where the speed limit is 40 mph.

The investigation report released today indicates that Patsy Sizemore, 69, of Smithers had a yellow traffic light and should have yielded to officer Brandon Tagayun, 25, when Sizemore began turning left onto 46th Street from McCorkle Avenue westbound.

Sizemore died at the scene of the accident, but authorities said the crash would "likely have been survivable" if she had been wearing her seatbelt.

"The primary cause of this collision is failure of Mrs. Sizemore, operator of the westbound Toyota pickup, to yield to the eastbound Charleston police cruiser," the report states.

The report was released this morning during a news conference at Charleston City Hall. The crash has stirred controversy since it occurred Oct. 14, with some anonymous witnesses saying they believed the cruiser ran a red light.

The report issued today concluded Sizemore was required to yield to eastbound traffic at the intersection due to the yellow light and could have clearly seen the cruiser approaching. The cruiser was 308 feet from the intersection when the Sizemore pickup began to turn left at the intersection, the report said.

Tagayun struck the passenger side of the truck with his cruiser as he headed at a high speed to serve as backup at the scene of a domestic violence situation at the Kanawha Mall.

The report said the officer could not have seen the Sizemore pickup until it had already entered the intersection. Authorities found Tagayun would have had about 1.8 seconds to react.
